Part A: Terms and Conditions

1. Who these terms are between

"We", "us" and "HushAway®" mean Peace in Sounds Ltd, company number 17364669, registered office D S Burge and Co Ltd, The Courtyard, 7 Francis Grove, London SW19 4DW. "You" means the creator receiving the Creator Pack.

By accepting a Creator Pack you agree to these terms.

2. What you receive

A HushAway® Creator Pack, sent to you free of charge. It contains six product cards, a letter with a QR code that is yours alone, and a few small extras.

Access to six recordings from the Sound Sanctuary, opened by scanning the QR code in your pack.

An invitation, around three weeks later, to a free one month trial of the full Sound Sanctuary for you and your family.

There is no payment, in either direction. The pack is a gift, and nothing in these terms obliges you to spend money.

3. What we ask, and what we do not require

We would love you to share three of the six recordings, in your own words and your own style, tagging @hushaway_peace and using #HushAway and #FindingPeaceInTheLittleSounds.

This is a request, not a condition. You keep the pack and the access whether or not you post. We will not chase you, invoice you, or ask for anything back. If the recordings are not right for you or your family, we would genuinely rather you told us than posted something you did not mean.

You decide what you say, when you say it, and whether you say anything at all. We do not approve your content before it goes out, and we do not ask for edits.

4. Being clear that it was a gift

If you do post about HushAway®, UK advertising rules require that your audience can tell the content was gifted. Please label it clearly, for example with #gift, #gifted or "gifted by HushAway®", somewhere visible without anyone having to tap "more".

This is the one thing in these terms that is not optional, because it is the law rather than our preference. It protects you at least as much as it protects us.

5. What you can say about HushAway®

Say whatever you honestly think. There are two limits, and both exist because we are talking about children.

HushAway® is a sound therapy informed regulation tool. It is not therapy, it is not a medical treatment, and it does not diagnose, treat, cure or prevent anything. Please do not describe it in those terms, and please do not say or imply that it treats a condition such as autism, ADHD or anxiety.

Please do not present your experience as a clinical outcome or a guaranteed result. "It helped our bedtime" is true and useful. "It fixed my son's sleep disorder" is neither.

Everything else is yours. You are free to say what did not work as well as what did.

6. Your children

We never ask you to feature your child, and we never will. Nothing you receive depends on it.

What we are genuinely interested in is your view as a parent: what you noticed, what surprised you, what you would tell another parent. That is worth far more to us than footage of a child.

If you do choose to include your own child in something you post, that is your decision and your responsibility as their parent. We may decline to reshare content featuring a child, at our discretion, and we would ask you not to take that personally.

7. Your content

Anything you create is yours. You own it, and you can take it down whenever you like.

By tagging us, you give us permission to reshare your post on HushAway® channels and in our marketing, with credit to you. If you would rather we did not, tell us and we will stop. If you take a post down, we will take our reshare down too.

This permission runs for as long as your post stays up. It ends when you take your post down, or when you ask us to stop.

8. Our content

The recordings, the cards, the artwork, and the names HushAway®, The PeacePath® and SoundSonic® belong to us.

You may film and photograph the cards and the pack, and play the recordings in your own content. Please do not upload the recordings on their own, share the audio files, or pass your QR code or its link to anyone else. Your code is unique to you and is how we know your box arrived.

9. Keeping things confidential

Confidentiality is covered in Part B. If the two parts ever conflict, Part B takes precedence on confidentiality.

10. Your personal information

We collect your name, email address and postal address so that we can send your pack and keep in touch. We hold this in Kajabi. We will not sell it or pass it to anyone outside HushAway®. You can unsubscribe from our emails at any time, and you can ask us to delete your details by emailing hush@hushaway.com.

Our full privacy policy is at www.hushaway.com/policy-policy. We hold your details on the basis of your consent, which you give by signing this agreement, and you can withdraw that consent at any time by emailing hush@hushaway.com.

11. If either of us wants to stop

You can step away at any time, for any reason, by telling us. We can do the same. There is nothing to repay and nothing to return.

If we ask you to take down a post because it breaches section 4 or section 5, please do so promptly. That is the only circumstance in which we will ask.

12. General

This agreement, both parts together, is the whole of what is agreed between us.

It is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If we need to change these terms we will tell you, and the change will apply going forward rather than backwards.

Part B: Non-Disclosure Agreement

This is a short agreement about keeping a few specific things private. It is deliberately narrow. It does not stop you posting about HushAway®, and it does not stop you working with anyone else.

1. Who this is between

The same two people as Part A: Peace in Sounds Ltd, and you.

2. What is confidential

Anything we share with you that is not already public. In practice that means: recordings, stories, affirmations or soundscapes that have not been released; products in development, including the HushAway® POD, PeacePacks, and anything from Series 4 or 5; research findings, school case studies, and anything shared with us by the Circle of Experts before publication; partnership or funding conversations that have not been announced; pricing, commercial terms or plans that are not on our website; and anything we tell you is confidential at the time we share it.

3. What is not confidential

Your Creator Pack is not confidential, and neither are the six recordings it opens. They are yours to listen to, film, photograph and talk about publicly. That is the whole point of sending them to you.

Nothing here is confidential if it is already public, if you already knew it, if someone else tells you without being under their own obligation, or if you work it out independently.

Your own honest opinion of HushAway® is always yours to share, including if that opinion is unfavourable. This part covers unreleased information, not your view of what we make.

4. What we ask

Keep confidential information to yourself. Do not publish it, post it, or pass it on. If you need to share something with a partner, agent or manager in order to work with us, that is fine, as long as they keep it private too.

Please use it only in connection with your involvement with HushAway®, and not for anything else.

5. How long this lasts

Three years from the date you sign. Anything that becomes public before then stops being confidential from the moment it does.

6. If you are required to disclose

If a court, a regulator or the law requires you to share something, you may. Please tell us first if you are allowed to, so that we know.

7. Returning or deleting

If we ask, please delete or return any unreleased material we sent you. You can keep your Creator Pack and anything already public.

8. What this part is not

It does not make you an employee, a contractor or a partner of HushAway®.

It does not oblige you to post anything. Part A covers that, and it is a request rather than a condition.

It does not stop you working with other brands, including brands like ours.

It does not transfer ownership of anything, in either direction.

9. General

This part is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of it turns out to be unenforceable, the rest still stands.
